These Terms of Service ("Terms") govern your access to and use of the CleanSMP Minecraft server, our website, our Discord server, and any related store or support channels (together, the "Services"). CleanSMP ("we", "us", "our") is operated by [TRADING NAME — e.g. "Jane Smith, trading as CleanSMP" or your company name and number], of [POSTAL ADDRESS], United Kingdom, contactable at support@cleansmp.net. By connecting to the server, using the website, joining the Discord, or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf, including any purchases made. The Services are not directed at children under 13, and we do not knowingly collect personal information from anyone under that age, or under the higher minimum age that applies where you live if your country sets one — if you believe a child under the applicable age has given us personal information, contact support@cleansmp.net so we can remove it.
We may update these Terms from time to time. Where a change is significant we'll make reasonable efforts to flag it (for example, via Discord or the website). Continuing to use the Services after an update means you accept the revised Terms.
You need a valid, unmodified copy of Minecraft to use the server. The server currently supports Java Edition only; Bedrock Edition access through a Geyser bridge is planned, and these Terms will apply to it in the same way once it is available. You're responsible for the security of your Minecraft and Discord accounts and for all activity under them. We're not responsible for losses caused by unauthorised access resulting from your own negligence, such as sharing your login details.
Using the Services, you agree not to:
This sits alongside the more detailed day-to-day rules posted in-game and in our Discord, which form part of these Terms and may be updated to reflect ongoing moderation needs. We reserve the right to interpret and enforce both at our reasonable discretion.
Tiers and other Virtual Items are licensed to you for use on the Services, not sold outright. All Virtual Items, accounts, and associated data remain our property; we grant you a limited, revocable, non-transferable licence to use them while your account is in good standing and, where applicable, your subscription is active. We may modify, rebalance, suspend, or remove Virtual Items — including for gameplay balancing, resets, or migrations.
Where a change removes or materially reduces something you are currently paying a subscription for, you may cancel your subscription and ask us for a refund covering the unused part of the period you have paid for. Outside that, and except as set out in our Refund Policy or required by law, changes to Virtual Items don't carry a right to compensation.
We may suspend or terminate access, remove Virtual Items, or take other proportionate action against accounts that breach these Terms or our server rules. Depending on severity, action may be taken without prior notice and may extend to other accounts we reasonably believe are linked to yours, where doing so is proportionate to the breach.
You can appeal any enforcement action by emailing support@cleansmp.net, and a person — not an automated system — will review it. Our decision on an appeal is final as far as our own internal process goes, but nothing in this section affects your right to take the matter further, including to a court or an alternative dispute resolution body.
Purchases are processed by Tebex Limited, acting as merchant of record for all transactions — they handle payment collection and card/PCI compliance, not us directly. Your refund rights are set out in our separate Refund Policy. Because Tebex is the merchant of record, Tebex's own terms also apply to the payment itself; where they give you more than this Policy does, theirs apply.
Tiers are recurring subscriptions. They renew automatically at the interval shown at checkout, and continue until you cancel. You can cancel at any time using the "Manage Subscription" link in your subscription email; cancelling stops the next payment and you keep the tier until the period you've already paid for ends. Prices shown include any tax we're required to charge. If we increase the price of a tier you subscribe to, we'll tell you at least 30 days beforehand and you can cancel before it takes effect.
The Services may be discussed or promoted on third-party platforms (Discord, social media, marketplaces). We're not affiliated with those platforms unless we say so explicitly, and any listing or transaction involving CleanSMP accounts, items, currency, or access conducted through a third-party platform without our written authorisation is strictly prohibited and void as against us.
The Services are provided "as is" and "as available". To the fullest extent the law allows, we exclude all warranties, express or implied, about their availability, accuracy, or fitness for purpose. Nothing here limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that can't lawfully be limited or excluded.
If you're a consumer, this section does not affect your statutory rights in respect of digital content — in the UK, the rights under the Consumer Rights Act 2015 that a Tier must be of satisfactory quality, fit for a purpose you made known to us, and as described, together with the remedies that come with them. Consumers elsewhere keep the equivalent rights their own law gives them. Those rights cannot be excluded, and we don't try to.
Subject to that, we're not liable for losses resulting from bans, suspensions, removal of Virtual Items, downtime, data loss, or changes to the Services, except where required by applicable law, including consumer protection law in your country of residence.
These Terms are governed by the laws of England and Wales. If you're a consumer resident elsewhere, this choice of law cannot deprive you of the protection of any provision of your own country's law that can't be departed from by agreement — those provisions continue to apply to you whatever this section says.
You may bring proceedings against us in the courts of England and Wales, or in the courts of the country where you live if your local law gives you that right. Where you are a consumer, we will bring any proceedings against you only in the courts of the country where you live.
CleanSMP is an independently operated Minecraft server and is not affiliated with, endorsed by, or sponsored by Mojang Studios, Microsoft Corporation, Discord Inc., Tebex Limited, or any other trademark holder referenced on our Services. All trademarks belong to their respective owners.
If something has gone wrong, email support@cleansmp.net with the details and your Minecraft username. We aim to acknowledge complaints within 5 working days and resolve them within 30. If we can't resolve it between us, you may be able to use an alternative dispute resolution scheme or the consumer advice body in your own country — in the UK, Citizens Advice. This doesn't affect your right to go to court.

We keep the personal data we hold to what we need to run the Services, keep them secure, and moderate fairly.
We don't keep a permanent log of all in-game or Discord chat — only what's captured as part of a support ticket, report, or moderation action as described above. We don't retain continuous or bulk voice recordings, and we don't store the Minecraft client version you connect with or any data from anti-cheat checks beyond the real-time connection decision itself. The store link data described above holds no payment information and no contact details — only a username, a UUID, and which tier you have.
Depending on the activity, we rely on the following legal bases under UK/EU GDPR:
Data is stored in our game server infrastructure and logs, our support/ticket and Discord systems, and with service providers who help us run the Services (hosting, DDoS protection, ticketing tools, and Cloudflare, which serves this website and holds the store link data described above) under appropriate contractual safeguards. We don't sell your personal information. We share it only with those service providers, with Tebex Limited for the purpose of processing your purchase, or where required by law or to protect the rights, safety, and security of our users and the Services.
Our infrastructure and service providers may be located outside the UK/EEA, including in the United States. Where that happens, we rely on appropriate safeguards — such as the UK's International Data Transfer Addendum or the EU Standard Contractual Clauses — to protect your data in line with UK/EU GDPR.

We may keep specific records for longer where needed for security incidents, fraud or chargeback prevention, ban-evasion prevention, or to resolve an active dispute, report, or appeal. Backups and replicated systems may briefly retain data past these targets before it's cleared on a rolling schedule.
We use reasonable technical and organisational safeguards appropriate to the sensitivity of the data involved, including access controls that limit who on our team can see it.
Depending on where you live, you may have the right to ask us for access to, correction of, or deletion of your personal information, and — for UK/EEA residents — rights to restrict or object to certain processing (including the tier lookups described in section 2, which we carry out on the basis of legitimate interests), or to data portability. UK/EEA residents also have the right to complain to a supervisory authority — in the UK, the Information Commissioner's Office. Residents of other countries — for example under Canada's PIPEDA, US state privacy laws, or Australia's Privacy Act — have broadly equivalent rights under their own local law, which we'll honour so far as it applies to you.
To make a request, email support@cleansmp.net with your Minecraft username and UUID if known, what you're asking for, and, if relevant, the date range involved. We may need to verify your identity before disclosing account-linked information such as IP history or ticket transcripts, so we're not handing your data to someone else.
Our anti-cheat checks decide automatically whether a client may connect, and some enforcement action (for example, an automatic temporary kick) happens without a person looking at it first. If an automated decision affects your access, you can ask us to review it — email support@cleansmp.net and a person will look at it, explain the reason, and put it right if it was wrong. We don't use your personal information for profiling or for advertising.
The Services aren't directed at, and we don't knowingly collect personal information from, children under 13 — or under 16, or whatever age between 13 and 16 your country sets as its minimum for online services, where that is higher. In the United States, we do not knowingly collect personal information from children under 13 within the meaning of COPPA. If you believe a child under the applicable age has given us personal information, contact support@cleansmp.net and we'll delete it.
We may update this Policy from time to time; the "Last updated" date above reflects the current version. Significant changes will be flagged on the website or our Discord.

Tiers and other Virtual Items sold through the CleanSMP store are digital content, applied to your account automatically — generally within seconds of payment clearing, or the next time you join if you're offline. Because delivery is immediate, purchases are generally final and non-refundable once the Virtual Item has been applied — subject to your cancellation rights in section 2, the cases in sections 4 and 5, and anything the law requires.
If you're a consumer based in the UK or EEA, distance-selling law — the Consumer Contracts Regulations 2013 in the UK, and the equivalent Consumer Rights Directive in the EU — normally gives you 14 days to cancel an order and get a refund. For digital content like ours, that right ends early once we start delivering it, but only if all three of these are true: you gave express consent to delivery beginning straight away, you acknowledged that doing so ends your right to cancel, and we confirmed that to you durably. Checkout is operated by Tebex as merchant of record and is designed to capture that consent and acknowledgement.
If any of those three didn't happen on your purchase, you keep your full 14-day cancellation right and nothing in this Policy reduces it. The same applies if you bought a Tier and it hadn't yet been applied to your account when you asked to cancel.
Except where the law says otherwise, we don't refund:
Upgrading to a higher tier is a new purchase. It credits the time left on your current tier, but it does not cancel your existing subscription — you need to do that yourself using Manage Subscription in your subscription email. We warn you about this at checkout and in our FAQ.
If you upgrade and are then charged for both tiers, contact support@cleansmp.net with your transaction IDs. We'll cancel the redundant subscription, and we'll normally refund a duplicate charge taken after an upgrade where you hadn't had the benefit of the lower tier separately. This is offered as a matter of fairness rather than because the law requires it, and it doesn't affect your statutory rights below.
If a Tier doesn't apply correctly, or you were charged without receiving what you paid for, that's on us to fix — email support@cleansmp.net with your transaction ID and we'll investigate, apply the correct item, or refund you as appropriate. This is separate from, and unaffected by, the cancellation-right position described above.
Please contact us before opening a chargeback or payment dispute with your bank or card provider — most issues can be resolved faster that way, and we'd rather fix the problem than argue about it.
Where a chargeback is raised without contacting us first, we may suspend the account and withdraw the Virtual Items it relates to while the dispute is investigated, and may keep that suspension in place if the dispute is resolved against you. We won't penalise you for a chargeback that turns out to be justified, or for one arising from card fraud you didn't commit. We reserve the right to contest chargebacks and provide evidence to payment providers, including Tebex Limited, who act as merchant of record for these transactions and may be the party your bank actually contacts.
Outside of the above, we may, at our discretion, offer a refund or other resolution in exceptional circumstances. Doing so once doesn't create an obligation to do the same in future, similar cases.
Nothing in this Policy affects your statutory consumer rights under the law of your country of residence, including — without limitation — the UK Consumer Rights Act 2015, EU consumer protection law, and equivalent protections in the US, Canada, Australia, and elsewhere. Where this Policy conflicts with a right you can't waive under that law, your statutory right applies.
Tebex Limited is the merchant of record for every purchase: they are the seller for payment purposes, they collect the money, and their own terms apply alongside this Policy. Where Tebex's terms give you more than this Policy does, theirs apply. We remain responsible for the Services themselves and for applying what you bought.
